Terms of service
These terms govern the use of FingerFood Manager — software for running a catering business, offered on a subscription.
Who provides the service
The service is provided by BDS Experts Leszek Szejka, registered at ul. Lipowa 61, 44-102 Gliwice, Poland, tax identification number (NIP) 6312579527.
What the service is
FingerFood Manager is a web application for handling orders, offers, customers, products, price lists, shopping lists and costs in a catering business. Which features are available depends on the plan and the modules purchased.
What you need to use it
Using the application requires a device with internet access, a current version of a popular web browser (such as Chrome, Firefox, Safari or Edge) with JavaScript and cookies enabled, and an active e-mail address. Signing in with Google additionally requires a Google account.
Accounts
An account is opened by the catering company, which then invites its own staff. Whoever issues an invitation is responsible for who receives access and how much of it. Sign-in credentials are personal and must not be shared. Each person accepts these terms in the application at their first sign-in; without acceptance the application cannot be used.
Subscription and payment
The subscription is billed monthly in advance at the price listed when the order is placed. A change of plan takes effect from the next billing period. Payment, invoicing and refund details are agreed individually.
Customer data
Data entered into the application remains the property of the catering company. We do not use it for our own purposes, do not disclose it to other customers, and do not train any models on it. It can be exported when the contract ends — the privacy policy describes how and by when.
Entrustment of data processing
Where a catering company enters personal data of its own customers or staff into the application, the company remains the controller of that data and entrusts its processing to us under GDPR Article 28. We process it only to provide the service and on the company's documented instructions, keep it confidential, protect it with appropriate technical and organisational measures, use Microsoft Azure (EU region) as a sub-processor, assist with requests from the people the data concerns, notify the company of any personal data breach without undue delay, and delete the data within 90 days of the end of the contract, as the privacy policy describes.
Acceptable use
The application must not be used unlawfully, to supply unlawful content, in breach of anyone else's rights, or in ways that threaten its stability — in particular by attempting to circumvent security controls, by large-scale automated extraction of data, or by reselling access without our agreement.
Availability
We work to keep the service running without interruption, but do not guarantee uninterrupted availability. Maintenance is scheduled outside peak hours and announced in advance.
Complaints
Complaints about the service can be sent to contact@fingerfood-manager.com. A complaint should describe the problem and name the account it concerns. We respond within 14 days of receiving it, to the address it was sent from.
Liability
We are liable for damage caused intentionally or by gross negligence. We are not liable for lost profits, nor for the consequences of business decisions taken on the basis of data in the application.
Ending the contract
The contract may be terminated at any time, effective at the end of the paid billing period. We may suspend access in the event of a material breach of these terms, after first asking that the breach stop.
Governing law
Polish law applies to this contract. Disputes are settled by the court with jurisdiction over the provider's registered office, unless consumer protection rules provide otherwise.
Changes to these terms
We give notice of changes by e-mail at least 14 days before they take effect. Not terminating within that period means the changes are accepted.
